Non-resident VAT registration UAE: when a foreign business must register

A company with no office in the UAE can still owe UAE VAT. The AED 375,000 threshold that protects small local traders does not apply to foreign businesses, so the real question is whether anyone in the UAE is already obliged to account for the tax on your supplies. This guide walks through that test, the reverse-charge shortcut for business customers, and the refund route for foreign firms that only incur UAE VAT.

How the HelloBooks AI agent handles it

You ask in plain English, the AI does the bookkeeping work, and you or your accountant approve the result.

  • You ask: “We are a UK software company. Which of our UAE invoices last year went to customers who are not VAT registered?”
  • The AI agent: HelloBooks filters every AED and GBP invoice by customer country and the TRN field, lists the UAE customers with no TRN on file, and totals those sales so you can see the exposure in one table.
  • You review: Your tax agent decides whether those sales trigger a registration duty and what date it runs from. HelloBooks prepares the numbers; nothing is submitted to the FTA without a person doing it on EmaraTax.

The rule: no threshold for foreign businesses

The FTA registration page states plainly that the mandatory threshold 'is not applicable to foreign businesses'. Article 13(2) of Federal Decree-Law No. 8 of 2017 sets the test instead: a non-resident must register if it makes supplies in the UAE and no other person is obliged to pay the tax on those supplies in the State.

Under Article 7(6) of the Executive Regulation, the FTA registers a non-resident with effect from the date it started making supplies in the State. That backdating is why the question is worth answering early, before invoices pile up with no VAT on them.

When the UAE customer accounts for the VAT instead

Article 30(2) of the Decree-Law puts the place of supply in the UAE when a supplier with no UAE residence provides services to a business recipient in the State. Article 48(1) then treats the UAE business importing those services as making a taxable supply to itself, which is the reverse charge. Because the customer is the person obliged to pay, the foreign supplier usually has no registration duty for those B2B sales.

The position flips when the customer is a consumer or an unregistered business. A Singapore e-learning platform selling AED 900 annual subscriptions to individuals in Dubai and Abu Dhabi has nobody in the UAE accounting for the 5% on its behalf, so the Article 13(2) test points at the platform itself.

  • Sales only to VAT-registered UAE businesses: the customer normally self-accounts under the reverse charge.
  • Sales to consumers or unregistered buyers in the UAE: the foreign supplier is likely to need its own TRN.
  • Goods held in the UAE and sold locally: look at the supply chain carefully with a tax agent before the first sale.

Refunds for foreign businesses that only pay UAE VAT

A foreign firm that attends a trade show at the Dubai World Trade Centre and pays hotel and stand-build VAT may be able to reclaim it. The FTA business visitor scheme requires that you have no place of establishment or fixed establishment in the UAE or any implementing state, are not a taxable person in the UAE, and are established in a country that refunds VAT to UAE businesses in similar circumstances.

The FTA sets a minimum claim of AED 2,000 of VAT, a claim period of 12 calendar months, and a submission window from 1 March to 31 August each year through EmaraTax. It quotes processing of about 40 working days. You need an original tax compliance certificate attested by the UAE embassy in your home country, plus valid tax invoices that show the supplier's TRN.

How HelloBooks keeps a non-resident ready

HelloBooks records each customer's country and TRN, tags every invoice line with its VAT treatment, and keeps sales in AED alongside your home currency with exchange differences tracked. The AI agent reads Arabic and English supplier invoices, so a hotel bill from Abu Dhabi lands in the ledger with its VAT and the supplier's TRN captured for a later refund claim.

If you do register, the same ledger produces the figures for each return period for your agent to review and file. Firms that want a specific chart of accounts or approval flow for their UAE branch can book a call at /book-a-demo.

FAQ

Frequently asked questions

Does the AED 375,000 threshold apply to a company based outside the UAE?
No. The FTA says the mandatory threshold does not apply to foreign businesses. The test is Article 13(2): whether you make supplies in the UAE where no other person is obliged to pay the tax.
We only sell consulting services to VAT-registered UAE companies. Do we register?
Usually not, because the UAE business customer accounts for the VAT through the reverse charge under Article 48(1). Confirm your facts with a UAE tax agent, especially if any customer is unregistered.
What is the deadline for a business visitor refund claim?
The FTA accepts claims between 1 March and 31 August each year, covering one calendar year, with a minimum of AED 2,000 of VAT per claim.
Can HelloBooks file our UAE return for us?
No. HelloBooks prepares the figures from your ledger. Your team or tax agent reviews them and submits on EmaraTax.
