When to file a VAT voluntary disclosure, and when a later return will do

A voluntary disclosure is how a UAE business tells the FTA it got a filed return wrong. Until 2026, many small errors required one. Since 1 January 2026, amendments to the Tax Procedures Law let businesses correct minor and nil-impact errors directly in a later return, with disclosures required only in cases the FTA specifies. Here is how to think about the decision, what it costs and how to prepare the numbers.

What changed on 1 January 2026

Federal Decree-Laws No. 16 and 17 of 2025 amended the Tax Procedures Law. As summarised by Baker McKenzie, taxpayers no longer need to file voluntary disclosures for nil-impact or minor errors and can correct them directly in the relevant tax return; voluntary disclosures are required only for cases the FTA specifies. The amendments also confirmed a five-year limit for voluntary disclosures.

The practical consequence is that the first question is no longer 'how big is the error?' alone. It is 'is this a case the FTA has specified as needing a disclosure?' Check the FTA's current decisions and guidance before deciding, because these rules have been revised more than once.

Typical errors and the likely route

Treat this as a starting point for a conversation with your tax agent, not a rule.

  • A missed reverse charge on foreign software where Box 3 and Box 10 cancel: no tax impact, often correctable in a later return.
  • A sales invoice reported in the wrong quarter, caught one period later: may be correctable in the next return depending on the FTA’s rules.
  • Input tax claimed on client entertainment for two years: underpaid tax, a strong candidate for a disclosure.
  • Sales reported under the wrong emirate: check the FTA rules, as emirate misreporting has previously been specified as needing disclosure.
  • A refund claimed that was too high: generally needs prompt correction through the FTA’s process.

What a late correction costs

Under Cabinet Decision No. 129 of 2025, effective 14 April 2026, a voluntary disclosure of underpaid tax carries a penalty of 1% a month on the tax difference from the original due date until the disclosure is submitted. If the disclosure follows an FTA notification of audit, a fixed 15% is added. An incorrect return also carries a fixed AED 500 penalty, or AED 2,000 for a repeat, unless the error is corrected before the due date or through a disclosure with no tax difference.

Example: a Dubai consultancy discovers it recovered AED 9,600 of VAT on client entertainment over the past twelve months. If it discloses now, before any audit, the monthly penalty depends on how long each amount has been outstanding; on an average of six months it is roughly AED 580. If it waits until the FTA announces an audit, a further AED 1,440 is added for the 15%.

Preparing the disclosure

The FTA wants to see the period affected, the original figures, the corrected figures and the reason. Build a schedule per tax period showing the boxes that change. Keep the evidence: the bills that should not have been claimed, the invoices posted to the wrong period, a short note of how the error happened and what you changed to stop it recurring.

Disclosures and returns are filed on EmaraTax by the business or its tax agent. Pay any tax due promptly, because the late payment penalty runs separately.

How HelloBooks supports the work

Most of the effort in a disclosure is reconstructing what was filed and what should have been. HelloBooks keeps each filed VAT period locked, so you can ask the AI 'show me all entertainment bills where VAT was recovered since January last year' and get the list with documents. It then drafts a period-by-period schedule of the corrections for your tax agent to check. The corrected entries are posted as visible adjustments, so the audit log shows exactly what changed and when.

FAQ

Frequently asked questions

Is there still an AED 10,000 threshold for disclosures?
The previous AED 10,000 test was replaced by the 2026 approach, under which the FTA specifies which cases need a disclosure. Check the FTA's current rules rather than relying on the old threshold.
How far back can I correct?
The amendments confirm a five-year limit for voluntary disclosures, measured from the end of the relevant tax period. Older errors may fall outside it.
Does a disclosure trigger an audit?
Not automatically. The FTA may ask questions about it, so a clear schedule and evidence make the review quicker.
Can I disclose an error in my favour?
Yes. Overpaid tax can be corrected too, but refund claims are subject to the five-year limit introduced in 2026, so do not delay.
