Form 8962 changes for 2025, and the bigger change coming in 2026

The 2025 changes to the premium tax credit form are technical. The real shift is in 2026, when the IRS says the credit stops above 400% of the poverty line and excess advance credit has to be repaid in full.

What changed for 2025

From January 1, 2025 a month can count as a coverage month, and earn a credit, even if part of the premium went unpaid, as long as what was paid (including advance payments) was enough to avoid termination under the scenarios the instructions list.

Coverage providers no longer have to send Forms 1095-B and 1095-C automatically in some cases. If a client asks for one, it must be provided by January 31 or 30 days after the request, whichever is later.

What the IRS says changes for 2026

The 2026 Form 1040-ES says the premium tax credit is no longer available above 400% of the federal poverty line, and the repayment of excess advance credit is no longer capped. Marketplace clients with rising income should update their marketplace estimate during 2026 to avoid a large balance due.

What to collect

  • Form 1095-A for every marketplace policy in the household.
  • Any 1095-B or 1095-C the client needs, requested from the provider if it did not arrive.
  • Mid-year income changes, so you can model the 2026 repayment risk.
