Backup Withholding Threshold for Payment Platforms | HelloBooks Proposed regulations tie platform backup withholding to the same $20,000 and 200-transaction test as Form 1099-K. What it means for seller clients.

Backup withholding on platform payments now follows the 1099-K test

Proposed regulations issued in January 2026 say payment platforms generally do not backup withhold on a payee until both the dollar and transaction thresholds are crossed. For most small sellers that removes a cash-flow surprise.

What the proposed rules say

Third party settlement organizations generally do not have to backup withhold on payments settled through their networks unless the gross amount paid to a payee exceeds $20,000 and the number of transactions exceeds 200 in the year. That lines withholding up with the Form 1099-K filing threshold, which reverted to its pre-2021 level.

The IRS notes that these thresholds do not change whether income is taxable. A seller under both thresholds still reports every dollar of business income.

Where clients still see backup withholding

Backup withholding is mostly triggered by a missing or mismatched TIN. A platform that crosses the threshold for a seller and has no valid TIN on file may start withholding, so the practical fix is unchanged: make sure every client selling through a marketplace has given the platform a correct TIN.

The proposed rules address payment networks only. They do not say anything about the 1099-NEC threshold, so do not assume the same test applies to your clients’ own vendor payments.

What to set up

For marketplace sellers, connect the platform payout account through bank feeds so payouts land in the books as they happen. Comparing those deposits with gross sales in the platform report shows fees and refunds clearly, which you will need whether or not a 1099-K arrives.
