VAT refund for businesses UAE: claiming excess input VAT

When the VAT you can recover in a period is larger than the VAT you owe, you hold a credit with the FTA. Exporters, businesses in a heavy buying phase and companies making zero-rated sales meet this often. You can leave the credit to offset later returns, or ask for it back through EmaraTax. This guide covers the law, the timelines for a decision, and the records that make a refund request go smoothly.

How the HelloBooks AI agent handles it

You ask in plain English, the AI does the bookkeeping work, and you or your accountant approve the result.

  • You ask: “Why are we in a refund position this quarter and how much is it?”
  • The AI agent: HelloBooks compares output and input VAT for the period, shows the net credit, and lists the largest drivers, for example zero-rated export sales and a large equipment purchase, with the supporting invoices.
  • You review: You decide whether to carry the credit forward or request a refund, and your accountant submits any request on EmaraTax.

What the law allows

Article 74(1) of Federal Decree-Law No. 8 of 2017 lets a registrant whose recoverable tax exceeds the tax payable claim the excess from the FTA, under the procedures in the Executive Regulation. Article 74(2) allows the FTA to offset the excess against tax or penalties owed. Under Article 74(3), any excess not claimed carries forward to later periods.

Example: a Jebel Ali exporter with AED 1.2 million of zero-rated sales and AED 900,000 of standard-rated purchases reports nil output VAT and AED 45,000 of input VAT. It can request the AED 45,000 or use it against future returns.

Timelines and process

The FTA's EmaraTax refund page says registrants can submit one consolidated refund request per tax type covering several tax periods, upload supporting evidence online, and that UAE bank account details are validated automatically before payment. The Tax Procedures Executive Regulation, amended by Cabinet Decision No. 17 of 2026 from 1 April 2026, keeps a 20 business day period for the FTA's decision and 5 business days to start repayment, and now applies these procedures to any credit balance in the taxpayer's favour.

The same amendment adds two years to record retention for periods covered by a refund claim that the FTA has not yet decided.

Making a request hold up

Refund requests attract checks, so expect questions about your biggest input VAT items and zero-rated sales. Have the documents ready before you submit.

  • Tax invoices for the largest input VAT claims
  • Export evidence for zero-rated sales
  • Bank statements showing payment of supplier invoices
  • A reconciliation of the VAT control account to the returns
