Small business relief UAE: who qualifies and what you give up

Small business relief lets a resident person with revenue of AED 3 million or less elect to be treated as having no taxable income for a tax period. Since Ministerial Decision No. 131 of 2026, the election stays open for any tax period that ends by 31 December 2029. The relief is generous, but it is an election with conditions, a revenue history test and a few trade-offs worth understanding before you tick the box.

The conditions

The FTA small business relief page sets the test: revenue must be AED 3,000,000 or less in the current tax period and in every previous tax period. Both natural and juridical resident persons can elect, and the election is made separately for each tax period in the return.

Two groups are shut out. Qualifying free zone persons cannot elect, and neither can members of a multinational group whose consolidated group revenue is more than AED 3.15 billion.

Why the history matters

The FTA gives an example that catches people out. A business with AED 4.3 million of revenue in 2025 cannot elect for 2026, even if 2026 revenue drops to AED 1.9 million, because an earlier period breached the limit. Once you exceed AED 3 million, relief is gone for later periods under the current rules.

That makes revenue recognition important. Revenue is measured from the financial statements, so invoices dated in the wrong year, or deposits booked as sales, can push a period over the line.

What you give up by electing

The FTA lists the effects of the election:

  • You are treated as having no taxable income for the period, so no corporate tax is payable.
  • Other exemptions, reliefs and deductions are not available for that period.
  • Transfer pricing documentation is not required, but the arm's length principle still applies to related party dealings.
  • You still register, file the return and keep the records that prove eligibility.

Tracking eligibility in HelloBooks

The AI agent keeps a running revenue total for each tax period from posted invoices and receipts, and flags when a period is approaching AED 3 million. A Fujairah contractor can ask "how close are we to the small business relief limit this year?" and get the figure with a list of the largest invoices behind it. The accountant still decides whether to elect, and confirms revenue against the final statements before filing.

FAQ

Frequently asked questions

Do I still file a return if I claim small business relief?
Yes. The election is made in the return, and the FTA reminded taxpayers that those eligible for relief must still meet the nine-month filing deadline.
Until when is small business relief available?
For tax periods that end no later than 31 December 2029, following the extension in Ministerial Decision No. 131 of 2026. Check for further decisions before planning beyond that date.
Is the AED 3 million limit based on profit or revenue?
Revenue. A business with AED 3.2 million of sales and a thin margin is outside the relief even though its profit is small.
Can a free zone company elect small business relief instead of the free zone regime?
A qualifying free zone person cannot elect. A free zone company that is not a qualifying free zone person is not barred by that rule, but should take advice on which route fits.
