Florida tax return changes for 2026

Florida has no personal income tax, so its federal conformity question is a corporate one. The 2026 adoption bill took the new Code date but left out the parts of the 2025 federal law that cost the most.

TIP 26C01-01

The Department’s Tax Information Publication of July 7, 2026 explains chapter 2026-137, Laws of Florida. It adopts the Internal Revenue Code retroactively to January 1, 2026 for corporate income tax, with exceptions.

  • Section 168(k) bonus depreciation and section 163(j) apply as in effect on January 1, 2025, without the One Big Beautiful Bill Act amendments.
  • Section 168(n) qualified production property and section 174A domestic research expensing are not part of Florida’s Code definition. Research costs follow section 174(a) as in effect on January 1, 2025.
  • Bonus depreciation on assets placed in service before January 1, 2027 is added back and recovered by subtraction over seven years.

Fiscal-year filers

The changes apply to tax years beginning on or after January 1, 2026. For a June 30 year-end company, the first affected year generally begins July 1, 2026.

Where Florida clients need you

A C corporation that expensed domestic research in 2026 federally will be amortizing it for Florida. Keep research wages and supplies in their own accounts in HelloBooks so both figures come from one place. Florida penalty rules are at /us/penalties/florida and sales tax at /us/sales-tax/florida.
