What HB 255 decouples

The Division of Revenue lists three One Big Beautiful Bill Act provisions Delaware does not follow, with detail in TIM 2025-02:

  • Retroactive treatment of unused capitalized research costs for 2022 to 2024.
  • 100% bonus depreciation.
  • The 100% special depreciation allowance for qualified production property.

Individuals

Because Delaware uses the federal definition of itemized deductions, the higher $40,000 SALT cap carries through for 2025. The tips, overtime and car loan interest deductions are not federal itemized deductions, so the Division says they do not reach the Delaware personal income tax return.

Business deadlines

Calendar-year partnership and S corporation returns were due March 16, 2026. C corporation returns, which start from federal taxable income with the HB 255 exceptions, were generally due April 15, 2026.

Two fixed asset registers

Delaware corporations now need a federal and a state depreciation schedule for assets placed in service after January 19, 2025. Record each asset once in HelloBooks with its in-service date and cost, and build both schedules from that list. Delaware has no general sales tax; see /us/sales-tax/delaware for what applies instead.
