Honest sender and subject, a physical address and an opt-out: the CAN-SPAM basics.

What CAN-SPAM requires

The FTC compliance guide lists the main requirements: no false or misleading header information, no deceptive subject lines, identify the message as an ad, tell recipients where you are located, tell them how to opt out, honor opt-outs within 10 business days, and monitor what others do on your behalf.

The law makes no exception for business-to-business email, and each separate email in violation can carry a penalty of up to $53,088, according to the FTC guide.

What Circular 230 adds

Section 10.30(a)(1) bars practitioners from public communications or private solicitations containing a false, fraudulent or coercive statement, or a misleading or deceptive statement. Enrolled agents may not describe themselves using the term certified.

Section 10.30(c) requires a copy of direct mail and e-commerce communications to be kept for at least 36 months from the last transmission or use. Archive each campaign as sent.

Segments that come from the books

Generic newsletters get ignored. Segments built from client records get read: business clients who paid contractors this year, clients with irregular income, clients who bought equipment. With client books in HelloBooks, those lists come from the ledger rather than from memory.

FAQ

Frequently asked questions

Are emails to existing clients exempt from CAN-SPAM?
Messages whose content is only transactional or relationship are exempt from most provisions, but the FTC says it views those categories narrowly. A newsletter or service promotion to clients is still commercial.
Do I need permission before emailing prospects?
The FTC guide describes an opt-out model for commercial email rather than a general prior-consent rule. State law, your email provider’s terms and good practice may ask for more.
